What Are Corporate Rights?
Corporate rights are the rights of a participant (shareholder) in a business entity — the owner of a share in its charter capital (or property) — granting the authority to participate in the management of the enterprise and to receive profits from its activities.
The law allows the transfer of these rights to other persons.
In the case of a farming enterprise (FE), only members of the same family or relatives listed in Article 3 of the Law “On Farming Enterprises” may be participants.
An alternative option is the alienation of the entire property complex.
In this case, the seller is the business entity itself, while in the sale of corporate rights, the seller is an individual co-owner.
To purchase corporate rights to land, this property must be separated from the general capital — in other words, a distribution of shares must be carried out.
Regarding taxation, the personal income tax (PIT) base is the investment profit — the difference between the received income and the value (nominal size) of the share.
The income tax (18%) and the military levy are paid by the seller.
